Women participate in conflicts, yet often in different ways to men. They also often participate in ways that are different to those envisaged by the drafters of international humanitarian law – who envisaged primarily male fighters, fighting particular types of wars.
Women participate in a range of ways in Africa’s civil wars. Serving as fighters, cooks, porters and armed group ‘wives’, women often form the backbone of fighting groups, performing functions on which armed groups are highly reliant.
Yet the narrow framing of the principle of distinction means that many of the roles that women typically play in conflict are not recognized as ‘combatancy’ or ‘direct participation’- even where women are actively engaged in armed movements. While this provides more women with legal protection from attack, indirect negative consequences flow from this.
